Terms of Service

These Terms of Service (“Terms”) govern your use of flpermitpay.com and the FL Permit Pay software and services (the “Service”) provided by FL Permit Pay (“we,” “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
FL Permit Pay is software for Florida trade contractors that helps with permitting, licensing and insurance compliance tracking, job and customer management, estimating and proposals, certified pay applications, and, where you enable it, billing and payment facilitation. The Service provides tools and information; it is not a law firm, accountant, or licensing authority, and it does not provide legal, tax, or permitting advice.
2. Accounts and eligibility
You must be at least 18 and able to form a binding contract to use the Service, and you must provide accurate account information. You are responsible for activity under your account and for keeping your credentials secure. The person or entity that subscribes and pays for the account (the account owner) controls the account and may grant or restrict access for other members, including access to payment and payout functions.
3. Subscriptions and billing
Paid plans are billed on a recurring basis through our payment processor, Stripe, at the price and interval shown when you subscribe. Subscriptions renew automatically until cancelled. You can cancel future renewals at any time; unless required by law, fees already paid are non-refundable, and cancellation takes effect at the end of the current billing period. We may change plans or pricing prospectively with notice.
4. Payments facilitation (billing your clients)
If you enable online payments to bill your own clients, you authorize us to help you create and connect a Stripe account through Stripe Connect. When you accept payments, FL Permit Pay never holds, controls, or takes custody of your funds. Money moves through Stripe directly to your connected account, subject to Stripe’s Connected Account Agreement and terms, which you must accept.
You are the merchant of record for payments from your clients. You are responsible for your services, your pricing, taxes, refunds, chargebacks, and compliance with applicable law in your dealings with your clients. Only the account owner, or a person the owner has expressly authorized, may connect, configure, or manage payments and payouts.
5. Acceptable use
You agree not to misuse the Service, including by attempting to access another organization’s data, reverse-engineering or disrupting the Service, uploading unlawful or infringing content, or using the Service to violate any law or the rights of others.
6. Connected services
You may connect third-party services such as QuickBooks Online. Your use of those services is governed by their own terms, and you authorize us to access and exchange data with them as needed to provide the features you use. You can disconnect a service at any time. We are not responsible for third-party services or their availability.
7. Compliance is your responsibility
FL Permit Pay helps you track permits, licenses, insurance, and certified-payroll obligations, and surfaces information drawn from public sources. You remain solely responsible for your licensing, permitting, insurance, tax, and other legal obligations and for verifying anything the Service surfaces against the official source before you rely on it.
8. Messaging (SMS and email)
When you send messages to your clients or team through the Service, you are responsible for having the necessary consent and for complying with applicable messaging laws. Where the Service collects consent to send text messages, message and data rates may apply, message frequency varies, and recipients can reply STOP to opt out or HELP for help. Transactional account messages are part of the Service.
9. Intellectual property and your content
FL Permit Pay and its software are owned by us and our licensors. You retain ownership of the data and content you put into the Service, and you grant us the limited rights needed to host, process, and display it to provide the Service to you.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that any information it surfaces is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, FL Permit Pay will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and the exclusive venue for disputes is the state or federal courts located in Florida.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, provide additional notice where appropriate. Your continued use of the Service after an update means you accept the updated Terms.
